Policies & Procedures

1. CHECK-IN / CHECKOUT – Check-in is at 3:00pm and check-out is at 11:00am, unless otherwise authorized by the Management Company.

2. MAXIMUM OCCUPANCY – The maximum number of guests is limited per unit. Extra guests and visitors are not allowed. It is very important that the maximum number of occupancy rule is not violated as this will be considered a breach of the reservation rules and will result in immediate cancellation of the booking.

3. TRASH – All trash is to be bagged and put in waste bins provided on the side of the property.

4. PETS – Pets are not permitted, a $250 fine applies.

a. Service Animals: Certification REQUIRED prior to arrival for access.

5. PARTIES OR EVENTS – There are to be NO LOUD GATHERINGS without prior authorization.

6. NOISE - It is essential that all outdoor entertainment and noise must stop by 10:00 PM out of respect for the neighbors. In accordance with the local noise ordinance, any excessive noise is prohibited at any time.

7. SMOKING – There shall be NO SMOKING inside the units. Smoking is permitted only outside of unit. If smoking is found out to be inside the property, guests will be charged a $150 smoking fee.

8. INSPECTIONS – Management has the right to inspect the premises without prior notice at any time to enforce the terms of this agreement, the rental period will be terminated immediately. Should a guest violate any of the terms of this agreement, the rental period will be terminated immediately. Guest waives all rights to process if they fail to vacate the premises upon termination of the rental period. The guest shall vacate the premises at the expiration time and date of this agreement. If there’s any damage to Units, guests are responsible for and will pay.

9. RESERVATIONS – a reservation deposit is required to reserve any Unit. This deposit will be applied towards the reservation balance. Reservations MUST be paid in full prior to arrival at the property or the keys to Unit reserved will NOT be given. ALL RESERVATIONS MUST BE PAID IN FULL PRIOR TO ARRIVAL, NO Exception.

10. CABLE TV – The service level is the Cable TV has been chosen by the Unit Owners. No refund of rents shall be given for outages, content, lack of content or personal preferences with regards to cable TV service.

11. INTERNET/WIFI – High Speed Wireless internet is provided as a convenience only and is not integral to the agreement. No refund of rents will be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regards to internet services.

12. A/C SYSTEM – Guest agrees that the Air conditioning shall not be set below 70 degrees and heat shall not be set above 78. Doors and windows shall be closed when either heat or air conditioning is in operation. Please do NOT Air Condition Florida.

13. POOL – It is the tenant’s responsibility to learn about safety precautions, warning signs of water conditions and safety procedures concerning swimming in or being around the pool. Guest agrees to have responsible adult supervising minors while they swim in the pool. Guests are hereby notified that the pool can be dangerous, and guests accepts fully the risk involved. All guests are further notified to be cautious when exiting from the pool, there’s no railing around the pool to prevent so be cautious when near pool.

14. LOST & FOUND – Valuable items left behind by guest will be held for the guest and every reasonable effort will be made to contact the guest for return. If items are not claimed for longer than 6 months, they will be the property of Southern Seas Resort. Southern Seas Resort shall not be held liable for the condition of said items.

15. ALTERATIONS - You may not make alterations or other additions to the property, including but not limited to, decorating, painting, nor install or maintain in the property or any part of the building, any fixtures, appliances, devices or signs without, in each case, our written consent. Any alterations, additions, or fixtures which are made or installed after you have received our prior written will remain apart of the property, unless we specifically agree or direct otherwise, and we shall not be obligated to reimburse you for any such alterations, additions and fixtures unless we specifically agree otherwise in writing.

16. SUBLETTING – The guests shall NOT sublet the property.

17. OUTAGES – We occasionally experience outages that are beyond our control. We report outages as each occurs. No refunds or compensations will be given for any outages.

18. WEATHER – There shall be no refunds of rents due to shortened stays or ruined expectations because of weather conditions.

19. REFUNDS – There will be NO refunds of rents due to shortened stays or ruined expectations due to work and family emergencies or other commitments.

20. FIREWORKS – Guest agrees that Fireworks and other hazardous materials shall NOT be used in or around the property.

21. HOME USE - Guest shall use the property for legal purposes only and other use, such as but not limited to, illegal drug use, abuse of any person, harboring fugitives, etc.; shall cause termination of the agreement with no refund of rents or deposits.

22. GAS – Guest is advised that the property may contain a gas stove & cooktop, gas heating, gas grill, and other gas-powered items and will seek help from management if the proper operation of such items is not fully understood.

23. NOTICE - Guest is advised that there is no carbon monoxide detector on the property and accepts the risk involved in not having one.

24. NO DAILY MAID SERVICE – While linens and bath towels and pool towels are available in units and are provided in the office, daily maid service is not included in the rental rate. A one-time cleaning fee is added once the guest is checked out. Other cleaning fees are available at an additional rate. We do offer starters for toilet tissue, paper towels, dish soap, garbage bags and laundry detergent. Propane refills are the responsibility of each guest. We do not provide refills, only the tanks.

25. FALSIFIED RESERVATIONS - Any reservation obtained under false pretense will be subject to forfeiture of advance payment/deposit and the party will not be permitted to check-in or subject to a lock out of the property.

26. WRITTEN EXCEPTIONS – Any exceptions to the above-mentioned policies must be approved in writing in advance.

27. PARKING – The Guest must park within the property. Any on-street parking shall be limited to one side of the street and kept off the grass or anyone else’s property. There is only 1 parking space permitted for each unit. All guests must make parking pass visible to be checked daily, if pass is not visible cars will be subjected to be towed at guest expense. If a guest has visitors, they will need to check in with the office and will need to park in other public parking areas located on Datura & Hibiscus Avenues, again if parking pass is not visible cars will be towed.

28. REPAIRS/REPLACEMENTS – Every attempt will be made to maintain the house in the best of condition. The managers do not express or imply any guarantee regarding suitability for any specific purpose. Managers does guarantee that appropriate repair and/or replacement will be performed as soon as possible. It is the guest responsible to notify the office of any issues that they incur during their stay so that repairs and or replacements may be promptly taken care of to the best of office ability. The office is not responsible for any inconvenience for which they have no control over. These conditions may include, but are not limited to, the following: weather conditions, power outages; adverse weather or road conditions.

29. HOLD HARMLESS – Guest agrees to indemnify, defend and hold harmless Manager and the owners of the Property against all loss, damage, expense, and penalty arising from any action of the Guest or visitors of the Guest which causes injury or death to any person or damage to any property including acts and omissions of Manager and owner even if due to manager or owner’s negligence. Guest agrees to indemnify and defend Manager & owners against any claims by third parties for money damages, injunctive relief or any such third-party claims relate in any way to the subject premises, including claims where the alleged harm was caused by Manager or owner’s negligence. Without the acceptance of this point, this Vacation Rental Agreement would never be signed and accepted by the Manager.

30. LIABILITY - Southern Seas Resort shall NOT be liable for any damage, loss or theft to property or injury to persons occurring within your Property or upon the other areas of the building premises unless the damage is caused by our gross negligence or intentional wrongdoing. You are responsible for obtaining your own casualty and liability insurance, and with respect to your family, licensees, or guest, agree to save and hold us harmless and indemnify us from any liability unless the damage is caused by our gross negligence or intentional wrongdoing. WE STRONGLY RECOMMEND THAT YOU SECURE INSURANCE TO PROTECT YOURSELF.

31. AGREEMENT - It is expressly understood and agreed that this is a short-term vacation rental (For US, under the provisions of Chapter 509, Florida Statues) and is not an agreement or other long term tenancy agreement. This agreement is only for licensed use of the Property for the stated Term. It creates no property rights in Guest and no rights to renewal or recurring usage. This agreement is also neither a Time-Share sale or Plan of Time-Share Development, nor Vacation Club. This Agreement is binding on, and the benefits inure to, the heirs and personal representatives of the parties. However, neither this Agreement nor any rights hereunder may be assigned (in whole or in part) by Guest.

32. CANCELLATIONS - a $75.00 cancellation fee is applicable upon booking any reservations. Guests can receive a refund of the accommodation fees if they cancel the bookings at least 7 days (full refund minus $75.00 cancellation fee that will be applied) prior to check-in time of booking. If a guest cancels on the same day of check-in a $100 cancellation fee will be applied.

33. COMPLIANCE WITH LAWS - In the event the terms of the Agreement are inconsistent with applicable laws, statues or ordinances shall supersede the terms of the Agreement, and such provisions are herby incorporated into the terms of the Agreement by reference.
